In submitting negligence questions to a jury, it is error for the trial court to permit a finding of fault on the part of one of several defendants where there is no evidence to show negligence of this defendant. But when this error occurs, and the erroneously included party is found partially at fault, an appellate court cannot order the case to be retried when a new verdict that differs on the fault of other parties would be contradicted by a clear finding of the jury in the first trial.
